1. Acceptance

By using Performance Analyzer and any associated integrations (including the Velodrome Timer), you agree to these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

Performance Analyzer is a web-based platform for analyzing athletic performance data from FIT and SRM files. The platform is designed primarily for cycling coaches and athletes, with potential support for additional sports. Associated integrations such as the Velodrome Timer provide real-time timing capabilities. All components are provided as-is for coaching, training, and performance analysis purposes.

3. License & Subscription

Access to Performance Analyzer is granted through a yearly subscription license. Each license is valid for twelve (12) months from the date of purchase and provides access to the full platform including all analysis tools, cloud storage, athlete management, and timing integrations. Licenses are per coach account and are non-transferable. Upon expiration, access to cloud features (dashboard, sync, athlete management) is suspended until the license is renewed. Locally loaded files and offline analysis remain available regardless of license status.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Coaches are responsible for the accuracy of athlete data they enter and for obtaining appropriate consent from athletes whose data they manage.

5. Data Ownership

You retain full ownership of all data you upload to Performance Analyzer, including activity files, athlete profiles, notes, and labels. We claim no intellectual property rights over your content. You grant us a limited license to store, process, and display your data solely for providing the Service.

6. Intellectual Property

Performance Analyzer, including its source code, design, algorithms, and documentation, is the proprietary property of Pavel Vitous. All rights reserved. You may not copy, modify, reverse-engineer, decompile, or redistribute any part of the software without prior written permission. Your subscription grants you a non-exclusive, non-transferable right to use the Service for its intended purpose only.

7. Acceptable Use

You agree to use the Service only for its intended purpose: athletic training analysis, performance tracking, and timing. You may not use the Service to store illegal content, attempt to access other users' data, or interfere with the Service's operation.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for data loss, service interruptions, or any damages arising from use of the Service. Training and coaching decisions based on PA analysis are made at your own discretion. Performance Analyzer is not a medical device and should not be used as a substitute for professional medical advice.

9. Refund Policy

Yearly license fees are non-refundable once the subscription period has begun, except where required by applicable law. If you experience technical issues that prevent use of the Service, contact support for assistance.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time, which will permanently remove all associated data. Termination or non-renewal of a license does not automatically delete your data — see the Privacy Policy for data retention details.

11. Changes

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes to pricing or license terms will be communicated via email at least 30 days before taking effect.
